1. Agreement to Terms
Welcome to Sunway Truck Repair. By accessing our platform, registering an account, or authorizing repair services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our platform or services.
2. Services & Repair Authorization
Sunway Truck Repair provides heavy truck maintenance, repairs, inspections, diagnostics, and parts replacement. By submitting a vehicle for repair and digitally signing an estimate or work order, you authorize Sunway Truck Repair to perform the specified services, install necessary parts, and operate the vehicle for testing, inspection, or delivery purposes.
3. Estimates & Pricing
All estimates are valid for 30 days. Estimates are based on initial inspections and diagnostics. If additional defects, required parts, or necessary labor hours are discovered during the repair process, we will contact you for authorization. No additional repairs exceeding 10% of the original estimate will be performed without your consent.
4. Electronic Signatures & Records
By digitally signing an estimate, work order, or invoice through our portal, you consent to conduct this transaction electronically and agree that your electronic signature is the legal equivalent of your handwritten signature, in accordance with the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and the Illinois Uniform Electronic Transactions Act. You may request a paper copy of any electronically signed document by contacting us using the information below.
5. User Registrations & Security
To access our customer portal, you must receive an invite code from our administration. You agree to provide accurate registration information and keep your credentials confidential. You are solely responsible for all activities that occur under your account.
6. Payment Terms & Stripe Integration
Payment is due in full upon completion of services and prior to the release of the vehicle unless pre-approved credit terms exist. We accept credit/debit card payments online via Stripe, cash, and wire transfers. Outstanding balances not paid within 15 days of invoice date are subject to a late fee of 1.5% per month or the maximum allowable by law. Vehicles left unpaid for more than 30 days may be subject to storage fees ($50/day) and mechanics lien procedures.
7. Customer Vehicles & Property Disclaimer
Sunway Truck Repair is not responsible for any loss or damage to vehicles or articles left in vehicles in case of fire, theft, accident, or any other cause beyond our reasonable control. Customers are advised to remove all valuables from their vehicles prior to service.
8. Parts & Labor Warranty
We guarantee our labor for a period of 90 days or 5,000 miles, whichever comes first, from the date of service. Parts warranties are subject to the manufacturer's terms. This warranty does not cover wear items, abuse, neglect, modifications, or subsequent damage caused by other failing components.
9. Limitation of Liability & Indemnification
To the maximum extent permitted by law, Sunway Truck Repair's total liability arising out of or relating to our services shall not exceed the amount you paid for the specific service giving rise to the claim. In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, lost business, or vehicle downtime, even if we have been advised of the possibility of such damages. You agree to indemnify and hold Sunway Truck Repair harmless from any claims, damages, or expenses arising from your breach of these Terms or misuse of our portal.
10. Intellectual Property
All content on our portal and website, including our name, logo, branding, software, and design, is the property of Sunway Truck Repair or our licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or use our branding or portal content without our prior written consent.
11. Termination
We may suspend or terminate your access to our portal at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent activity, or for any other reason at our reasonable discretion. You may stop using our portal at any time. Provisions of these Terms that by their nature should survive termination (including payment obligations, warranty limitations, and limitation of liability) will survive.
12. Dispute Resolution & Governing Law
Before filing a claim, you agree to first contact us so we can attempt to resolve the dispute informally. These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law principles. Any legal action arising under these terms shall be resolved exclusively in the state or federal courts located in Cook County, Illinois.
13. General Provisions
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with any signed estimate or work order, constitute the entire agreement between you and Sunway Truck Repair regarding our services. We are not liable for any delay or failure to perform caused by circumstances beyond our reasonable control, including natural disasters, parts supply shortages, or other events of force majeure.
